1. About Localist Film Shoot and Photo Shoot and this product schedule
Localist is working with multimedia providers to help you add video (‘Film Shoot’) and photos (‘Photo Shoot’) to your advertisements. Localist will arrange for a selected multimedia provider to shoot and deliver your video and photos, all for a simple, up-front fee. And at the end of the day, you'll own all the video and photos produced. More information is available on our website or from your Business Development Manager.
The terms and conditions in this product schedule apply to you if you sign up for Localist Film Shoot and/or Photo Shoot either online or by speaking to your Business Development Manager. These terms and conditions are in addition to our terms of business, advertising policy and our other terms and conditions and policies (all of these are available at www.localist.co.nz/p/legal-stuff). These additional terms apply to Localist Film Shoot and Photo Shoot as well, so if you haven’t already, you should read and consider these carefully. We may want to change these terms and conditions from time to time, so keep an eye out, as we will publish our amended terms and conditions on our website. Continuing to use or receive our products and services will mean that you agree to our changes.
2. What you need to do
If you already have a Localist Marketplace listing and want to sign up for a Localist Film Shoot and/or Photo Shoot package, all you need to do is sign up online or speak to your Business Development Manager. If you don't already have a Localist Marketplace listing, you will need to sign up for one first, but you can buy a Localist Film Shoot or Photo Shoot package at the same time.
You'll also need to work with the selected multimedia provider to prepare and finalise your video and photos. All Localist Film Shoot and Photo Shoot packages include uploading and hosting content on our website and our hosting service, but if you want to use your video and photos elsewhere (which you're free to do), you'll have to arrange and pay for that yourself.
Remember your video and photos (in whatever form) will be an advertisement for the purposes of our terms of business, and must comply with our advertising policy in all respects. You should note that we may at our discretion refuse to upload, or remove from your Localist Marketplace listing, any advertisement that fails to comply with our advertising policy. No refund will be provided.
3. What we do
Localist has developed a range of Film Shoot and Photo Shoot packages to suit your business. We'll arrange for a selected multimedia provider to prepare and finalise your video, or take and edit your photos. We'll also handle all uploading and hosting of your video and photos on our website and hosting service.
4. What the multimedia provider will do
Once you've confirmed your sales order, the multimedia provider will contact you and make arrangements for the video and/or photo shoot in your choice of Auckland, Hamilton, Wellington, Christchurch or Dunedin. The multimedia provider will professionally edit the work. Please note that these packages have a limited amount of edits or changes permitted. You may request one round of basic edits in accordance with your requested time coded changes. The multimedia provider will then seek your approval of the finished product, and finalise your video and photos for us to upload and host on our website and hosting service.
5. Charges
The charges for the Localist Film Shoot and Photo Shoot packages are set out on our website and on your sales order. .We may change our charges for Localist Film Shoot and Photo Shoot packages from time to time.
6. Payment and minimum term
This is an up-front payment product. This is explained more fully in our terms of business, but in summary means that you must pay the entire amount for your Localist Film Shoot and Photo Shoot package prior to the work commencing (you pay us, not the multimedia provider).
There are no additional fees for having video or photos on your Localist digital listing page. There is no minimum term for Localist Film Shoot and Photo Shoot; you can remove your videos and photos at any time (however you won't be entitled to any refund if you remove your videos and photos).
7. Ownership and intellectual property rights
You own all original content produced as part of your Localist Film Shoot and Photo Shoot; the only content you don't own is stuff that is licensed from someone else that is used as part of your video or photos (like background music, for example).
You grant us a perpetual, royalty free, non-exclusive and irrevocable licence or sub-licence to use, copy and modify all content produced as part of your Film Shoot and/or Photo Shoot. This means that we can use your video and photos on the Localist website, and for other activities (like showing other possible customers an example of Localist Film Shoot and Photo Shoot packages). It also means that we may sub-license the content to our multimedia providers for their own promotional purposes.
You also agree that all video content produced as part of a Localist Film Shoot may have a small Localist brand placed on it.
8. Complaints
If you have any complaints about your Localist Film Shoot or Photo Shoot, you should direct them to us in the first instance. We'll work with you and the multimedia provider to try and help you resolve any issues.
9. Legal status and liability
Localist and the selected multimedia providers are independent contractors, and our arrangements with the multimedia providers do not create any partnership, agency or employment relationship between us and the multimedia provider(s).
All Film Shoots and Photo Shoots are provided by a third party, not provided by Localist, and to the greatest extent permitted by law, we exclude all guarantees, representations, terms and warranties. We will not be liable for any loss or damage (direct or otherwise) that you suffer in connection with a Film Shoot or Photo Shoot or your use of any advertisement generated from a Film Shoot or Photo Shoot.
