About Get Started
This product schedule applies to Get Started in addition to our terms of business, advertising policy and our other terms and conditions and policies (all of these are available at www.localist.co.nz/p/legal-stuff). If you haven’t already, you should read and consider these terms carefully. We may want to change these terms from time to time, so keep an eye out, as we will publish our amended terms and conditions on our website. Continuing to use or receive our products and services will mean that you agree to our changes.
You will need a Marketplace listing to Get Started. If you don't already have a Marketplace listing, you will get one as part of Get Started. All you need to do is sign up online or talk to your business development manager. If you have an existing Marketplace, you can apply to upgrade your Marketplace listing to a Get Started package, which includes Marketplace. A 12 month term for Get Started will apply from the date of the upgrade).
Localist will provide for your business:
- A 12 month subscription for your Marketplace listing.
- Marketplace design
- Social media setup of your choice from our selected social media sites: Facebook, Twitter & Google +
- Social media design
- Social media Get Started guide/e-book
- A customised professionally designed digital advertisement. Images can be provided by you, or selected from our library of stock images.
- Business card design and printing. Where you have an existing logo/artwork, you can supply your own images. Otherwise, we will select an image from our library of stock images.
There is a minimum period of 12 months for Get Started. You will be contacted at the end of the 12 month period and advised to contact Localist within the notification period if you do not wish the contract to roll over for a further 12 month term. Unless we hear from you, your Get Started product will automatically roll over for another 12 month term.
You will also need to provide any imagery that you’d like to use, in high resolution format, if you’re not using our stock imagery. Remember that you must own or have the right to use your images, and that if you are using our stock imagery, you won’t have exclusive rights to the image you choose. This means that someone else could be using the same image in their advertisement. We take care of everything else!
You’ll be able to review and provide feedback on the professionally designed advertisement, and be entitled to one round of professional edits to the advertisement.
Social media sites
While we will set up your direct access to the available social media sites that you choose, and create your presence on those sites, you will be solely and completely responsible for managing your ongoing content, including maintaining and updating content and links and responding to posts from users of those sites.
Each social media site is governed by its own terms and conditions, which change from time to time. When you join a social media site, you agree to comply with those terms and conditions. Here are links to the available social media sites for your information:
While these are currently the available social media sites, please note that we reserve the right to add and remove social media sites from the Get Started package from to time.
You agree to provide us with your social media service provider password(s) to the extent required to carry out the Get Started services. Localist agrees to use the password only if necessary for the purpose of carrying out the Get Started services, not to disclose it to any third party and to delete reference to the password upon completion of the Get Started services.
Your business development manager will be able to explain how it all works. More information is also available on our website.
You will be provided with 250 new business cards as part of Get Started. Localist will design the front of your business card, either using your imagery/logo or a stock image on the front of the card, and the wording 'Rave about us on Localist' and in some cases an example of a rave received by your business on Localist.
Should you wish to order more cards, please talk to your business development manager. Prices will vary depending on the number of cards ordered.
The charges for Get Started are set out on our website and will be listed on your sales order. We may change our charges for Get Started from time to time, unless we have agreed in our sales order to charge you a fixed price for a defined period of time. Where we have agreed in our sales order to charge you a fixed price for a defined period of time, once that period expires you will be charged at our then-current charges.
Legal status and liability
The provision of the Get Started services does not create any partnership or agency between Localist and the available social media sites. You are responsible at all times for any content that you publish on the social media sites. The contracts that you enter into to use the respective social media sites will not be with Localist, but between you or your business (as the case may be) as account holder or customer, and the respective social media site as service provider.
The social media sites are provided by third parties, not Localist, and to the greatest extent permitted by law, we exclude all guarantees, representation, terms and warranties. We will not be liable for any loss or damage (direct or otherwise) that you suffer in connection with your use of any of the available social media sites.
About Design Studio - Print
When you purchase a one third page, or larger, premium advertisement in the Localist Good Guide, you can also purchase Design Studio – Print. Localist will provide for your business a custom professionally designed print advertisement. Images can be provided by you, or selected from our library of stock images.
You will also need to provide any imagery that you’d like to use, in high resolution format, if you’re not using our stock imagery. Remember that you must own or have the right to use your images, and that if you are using our stock imagery, you won’t have exclusive rights to the image you choose. This means that someone else could be using the same image in their advertisement.
You’ll be able to review and provide feedback on the professionally designed advertisements, and be entitled to one round of professional edits to the advertisements.
The charges for Design Studio – Print are set out on your sales order. We may change our charges for Design Studio – Print from time to time. This is an upfront payment product. This is explained more fully in our Terms of Business, but in summary means that you must pay the entire amount for your Design Studio – Print prior to the work commencing. There is no minimum term for Design Studio – Print.
Our standard pricing applies to a one third page advertisement. Pricing for larger advertisements will cost more, and will be determined on a case by case basis. Please talk to your business development manager if you are interested in a larger advertisement.
Ownership and intellectual property rights – Get Started and Design Studio – Print
You own all original content produced as part of your Get Started digital advertisement, or Design Studio - Print advertisement, unless we have used any content licensed from a third party, like stock images, to create the Design Studio advertisement.
You grant us a perpetual, royalty free, non-exclusive and irrevocable licence or sub-licence to use, copy and modify all content produced as part of your Get Started digital advertisement, or your Design Studio Print advertisement. This means that we can use your advertisement on the Localist website, and for other activities (like showing other possible customers an example of a Get Started digital advertisement or Design Studio Print advertisement).
You appoint us as your agent to carry out design services in relation to Get Started and/or Design Studio – Print in accordance with this product schedule and the Terms of Business.
